Why choose a family law attorney rather than doing it yourself?

How do I start the process?

At Bender Law Offices, we offer a no-obligation initial consultation at a small fixed fee. This fee is waived if you retain our services at the end of your consultation. We recommend that you get good information before starting the process or making any decisions. During this time, we will give you an overview of the law, your rights and obligations, and give you a chance to evaluate your level of comfort and compatibility with our office and its legal philosophy. Why can’t the attorney just answer one question for me over the phone?

Your “just one question” may be more complex than you know. When an attorney gives advice, it must be carefully tailored to the individual client. Even though one person’s situation may seem just like that of another person, there may be many things that could cause a different result. To answer without knowing the facts could cause both you and the attorney many problems. A phone consultation can be set up to save you from coming to our office, but you need to allocate some time to it as phone consultations usually take about one hour. We don’t recommend email because it is not secure and is poorly suited for client-attorney privilege requirements.

What are the legal fee arrangements?

During your consultation, the attorney will tell you what the initial retainer will be based on an initial evaluation of your matter. At Bender Law Offices, we always have a written fee contract for you to review before signing. We accept Visa, MasterCard and American Express, as well as checks or cash. Unless you retain the services of our law firm, no attorney-client relationship will begin.

If you have special requirements or concerns about your ability to afford the level of service you need, don’t hesitate to call. We keep an attorney referral list and may be able to help you find a less expensive attorney if your matter is not too complex. Our priority is matching your matter to the right level of legal expertise.

Can the other side pay my fee?

In certain instances, especially in the areas of child custody, support and alimony, a court will order the opposing party to pay your attorney’s fees. However, such awards are at the discretion of the court and even if granted may not be sufficient to cover your entire legal fee. Payment of your fees may also be part of a negotiated settlement. The court can also order that marital property be released to you to allow you sufficient funds to retain counsel. Bender Law Offices will pursue these avenues for you, however, regardless of these possibilities, you remain primarily responsible for the payment of your fee.

Is my case a matter Bender Law Offices would handle?

Bender Law Offices, PC is a full-service family law firm. We offer family law services for before, during and after marriage, as well as for all related matters (including children). Because of our family law attorneys’ abilities and experience, our firm is able to undertake representation of complex and/or high asset matters and provide effective representation in high-conflict situations as well as more conventional matters.
