In North Carolina child support is set by state wide guidelines which are reviewed every few years to adjust the support in line with economic conditions. The guidelines were adjusted in October, 2002. The guidelines are based on a shared income model. That means that the income of each parent is included in the calculation. The combined income is then assigned a certain support obligation which is then assigned to each party in percentage to which that person's income bears to the total income of the parties. After the basic support obligation is determined, additional support needed for health insurance, child care, and extraordinary needs is added to the support obligation and the same percentage is assigned to that additional amount. Only 75% of the day care cost is allowed based on the notion that there is a 25% tax credit available for the payor. Support differs by income and by responsibility for the care of the children based, primarily, on the number of overnights a child spends with each parent. Schedule “A” is based on one parent having sole custody, the other parent has the child up to one third of the time (122 overnights or less). Schedule “B” is shared custody where each parent shares at least one third of the overnights. Schedule “C” is where there are two or more children and at least one child lives with each parent. The following article is a detailed explanation of how child support is calculated. It is possible to deviate from the guidelines where extraordinary circumstances or the interests of justice so require. However, if you need to determine support, the guidelines are your best starting place. The North Carolina Administrative Office of the Court has a web site that can give you the actual guidelines.
